Maintenance courts in South Africa fail women badly, says gender activist

Maintenance courts in South Africa fail women badly, while the government lacks the political will to address gross economic injustice done to SA women, said Felicity Ann Guest, well-known gender activist and founder of Child Maintenance Difficulty in South Africa.
Guest was the keynote-speaker at a 1000 Women 1 Voice festival to celebrate the 20th anniversary of 1000 Women 1 Voice at the Vanguard community Hall in Vanguard on Thursday.
Guest, a survivor of gender-based violence and activist, said there are 19 million children in South Africa of whom 70 % grow up without a father.
A total of 60 % of South African women with children get no financial support for their children from the fathers, Guest said.
“There is no protection for the mothers at the maintenance courts. The legal provisions are all in the favour of the person who is avoiding maintenance. There is no punitive action for not appearing in court, for not providing the court a change of address or change of work place,” said Guest.
“They do not want to criminalize defaulters who do not pay on time.
They reimburse men for attending court. Orders are not retrospective. Men often pay lawyers to pay less maintenance. Or they change lawyers to delay hearings or they order 50/50 contributions when the Act clearly states that the maintenance payment should be proportionate to earnings,” Guest said.
Guest warned about the downward spiral to which women are often exposed by abusive men in a relationship. “One of the things that men do to keep women economically dependent, is to impregnate them.
“Then they isolate you from your family, and thereafter diminish your self-worth by bad-mouthing you with phrases like “nobody wants you” and “you are ugly.” After that happens, the perpetrators use physical abuse against the women.
“When women leave for a shelter, they often return to their perpetrators as money is the glue that irons women to the perpetrator.”
Guest said there is no policies in place in South Africa to protect female employers from economic abuse. “There is a national crisis in this country as women will never be liberated if they do not receive economic justice,” said Guest.
